1. Introduction
These terms govern the sale of appliances from Hivalue Appliance (“Seller”) to the purchaser (“Buyer”). By placing an order, the buyer agrees to these terms.
2. Products
Descriptions, images, and specifications are provided for reference only. Seller may make reasonable changes without prior notice.
3. Pricing & Payment
All prices are firm, in Canadian Doller, and exclude applicable taxes unless stated otherwise. Payment is due in full before delivery unless otherwise agreed in writing.
4. Delivery
Delivery dates are estimates only. Seller is not liable for delays beyond it's reasonable control. Risk of loss passes to buyer upon delivery to the carrier.
5. Inspection & Acceptance
Buyer must inspect goods upon receipt and notify seller of any defects or shortages within 3 days. Failure to do so constitutes acceptance.
6. Returns & Refunds
Returns are not accepted when buyers changed their mind. Under consumer law sales are considered final. If the appliance breaks down within the warranty period and has been professionally restored with all accessories, buyer has to bring it back to the store to fix it, and if not, the store may offer an exchange with similar or equivalent unit. The store may offer partial or full refund when repair or replacement cannot be done.
7. Warranties
Seller warrants that appliances will be free from material defects for 30 days from purchase date. This warranty covers electrical and mechanical failures that occur during normal use. It does not cover misuse, neglect, or normal wear and tear.
8. Limitation of Liability
Seller’s liability is limited to the purchase price. Seller is not liable for indirect, incidental, or consequential damages.
9. Governing Law
These Terms are governed by the laws of the Province of Ontario, without regard to conflict of law principles.
10. Entire Agreement
These terms, together with any written agreement between the parties, constitute the entire agreement regarding the sale of appliances.
